Statement 

 

On May 16, 2025, Governor Polis signed HB25-1312 into law. The law forces businesses like XX-XY Athletics to use individuals’ chosen names, preferred names and pronouns, and other inaccurate language about a person’s sex or face severe fines and penalties.  

 

But XX-XY Athletics doesn’t do that 

 

 We believe that men and women are different; sex is binary, biological, and immutable; and women deserve to be champions in their own sports. Thus, we refer to all individuals—including customers, prospective customers, visitors to our events and pop-ups stores, athletes, and public figures—using biologically accurate language. This includes birth names if we know them and biologically accurate pronouns. And we call boys, boys, and we call girls, girls. Doing otherwise would be a lie and contradict our core values. We’re not going to lie because the government tells us to, and we’re not backing down in the face of this law.  

 

We will not knowingly use biologically inaccurate language—not names, not pronouns, not honorifics, nor anything else. While we will happily sell our products to anyone, we will decline any and all requests from customers, prospective customers, or anyone else to use biologically inaccurate language. And we will continue to use language that is biologically accurate, no matter who it offends or who declines to buy from us because of it 

 

Our mission at XX-XY Athletics has always been to champion female athletes and protect women’s sports. We can’t do that if we’re forced to refer to the male athletes invading women’s sports as females. Whether transgender-identifying males should be allowed to compete in women’s sports is a hotly contested issue, and Colorado can’t tip the scales by silencing those of us standing up for women’s sports. In fact, the Constitution forbids it. The threats to women’s sports are too important to remain silent, and that’s why we are continuing to refer to individuals by their birth name and biologically accurate pronouns, regardless of what Governor Polis and the legislature demand.
